Gibbs to plead guilty to jail assaults |

Less than a month after pleading guilty to a 2004 rape in Fargo, Moe Gibbs is expected to change his plea to guilty on the charge that he sexually assaulted Barnes County inmates while he served as a corrections officer. Gibbs is accused of sexually assaulting five inmates while working at the Barnes County jail in 2006. The allegations came after he was accused of killing Valley City State University student Mindy Morgenstern in her off-campus apartment last year. Gibbs was recently found guilty of killing Morgenstern by a jury in Bismarck, but lawyers for Gibbs have requested a new trial. The first trial resulted in a mistrial after a hung jury couldn’t agree on a verdict. DNA from Gibbs found underneath Morgenstern’s fingernails matched with DNA evidence collected from a 2004 rape of a 22-year-old woman in Fargo. Gibbs changed his plea agreement to guilty two weeks after being convicted of the Morgenstern murder. The plea agreement hearing will be held at 1 p.m. Friday, Dec. 14, in the Barnes County Courthouse.
