Two others charged in minor case

Along with the former lone police officer of LaMoure, two other men are being charged with gross sexual imposition.
The former officer, Kyle Taft Mackey, 22, is being held in the Barnes County jail on three counts of gross sexual imposition, and luring a minor by computer or other electronic means.
Mackey served as LaMoure’s only police officer for six months, resigning shortly before his arrest.
According to LaMoure District Court documents, 24-year-old Brandon Trimble and 19-year-old Tyson Witt are charged with gross sexual imposition in the same case.
Trimble was originally being held in Barnes County but was transferred to Stutsman County about two weeks ago. Corrections officials said they were not holding Witt in Barnes County.
The documents allege the three men had sexual contact with a 14-year-old girl on a number of occasions beginning on Dec. 1, 2008. In addition, Trimble is charged with contributing to the delinquency of a minor by providing the alleged victim with alcohol, a Class A misdemeanor.
Gross sexual imposition is a Class AA felony with a minimum mandatory sentence of 20 years in prison with probation following. Courts may deviate from the mandatory sentence under certain conditions, but the law requires no less than five years incarceration.
Luring is a Class C felony, which requires lifetime registration as a sex offender.
