VC Man Violates Court Order

A man was jailed in Valley City on Wednesday on suspicion of violating a restraining order against him.

Herb Brady, living in southeast Valley City, was taken into custody by Valley City police officers Dave Swenson and Wade Hannig. He had allegedly violated an order prohibiting contact and a bail order out of Cass County.

“He was ordered not to have contact with the victim and he had contact with her,” said State’s Attorney Lee Grossman.

The two officers had investigated a report from a Valley City woman with a restraining order against Brady at 1:40 that afternoon. On the phone she told a police dispatcher that Brady had been at her house that day and she was scared for her safety. Brady was not at his southeast Valley City home when the officers came knocking at shortly after 5 p.m., but was taken into custody less than 20 minutes later near the Sheyenne Care Center.

On Tuesday, the female complainant called the police department at 3:14 a.m. and told a dispatcher she had a restraining order against Brady, and he had called her phone seven times in 20 minutes telling her he was having a stroke. The woman came in to the department to fill out a statement, and while she was doing so, Brady called her again.

Locally, restraining order violation penalties differ from situation to situation, and cases are adjudicated through the Barnes County State’s Attorney’s Office.

Grossman said Brady faces two A misdemeanors, each carrying a maximum penalty of a year in jail and/or a $2,000 fine.

“It’s wasn’t that she went through the protection order process and got a separate order by a judge, this is part of a bail order issued in a Cass County case,” Grossman said.
