Southeast Judicial District Judge Jay Schmitz determined that the Valley City Public School Board did negotiate in good faith with the Valley City Education Association as the two entities discussed contract negotiations from July last year through February.
Schmitz decided that a change to section three in the health insurance portion of the contract cannot be included because the court found the parties did not agree to negotiate to section three.

Valley City State University will host a Gathering for Remembrance to honor the life of the late Dan Buehner at 7:30 p.m. today in the W.E. Osmon Fieldhouse on the VCSU campus.
Buehner, a VCSU senior from Blaine, Minn., died Monday in a rafting accident on the Sheyenne River in Valley City. A business administration major, Buehner was the starting catcher on the VCSU Viking baseball team.
The gathering Wednesday night will include remarks by VCSU President Steven W. Shirley, athletic director Jack Denholm and baseball coach Casey Olney.
The Valley City Fire Department received three fire calls Tuesday â€“ all within 45 minutes.
The first call, which came in just after noon, was a corn field fire near the Peak exit off I-94. The fire was in a harvested field and spread slowly, according to Valley City Fire Chief Gary Retterath, but firefighters had a hard time maneuvering trucks in the field, which made fighting the fire difficult, he said.
While crews were busy at the Peak fire, they were called to a grass fire near Martin's Landing, north of Lake Ashtabula.
Two students from the Sheyenne Valley Career and Technology Center will represent Valley City at the state Ford/AAA Student Auto Skills competition May 2. Students Wyatt Hatcher and Micah Anderson, along with with instructor Jim McFadgen, will be at the Red River Valley Fairgrounds when 20 students from across North Dakota will compete for more than $126,000 in scholarships. Mrs. North Dakota-America visited Valley City Tuesday. Eliza Potratz, Jamestown, who was crowned Mrs. North Dakota at a pageant April 12, read to students at Jefferson Elementary School, visited residents at the Sheyenne Care Center and made a couple other stops along the way.

The body of Valley City State University student Dan Buehner was recovered from the Sheyenne River Tuesday morning.
"Buehner was a senior majoring in business administration and played catcher on the VCSU baseball team," said VCSU President Steve Shirley in an e-mail to the campus community. "He was from Blaine, Minn. and attended high school at Centennial High."
Buehner, 23, was one of three VCSU students who went into the Sheyenne River near the Little Dam in Valley City just after 1 a.m. Monday when the rubber raft they were aboard capsized.
Valley City State University President Dr. Steve Shirley said in an email to the university community that the male student whose body was discovered in the Sheyenne River Tuesday morning is Dan Buehner.
"Dan was a senior majoring in business administration and played catcher on the VCSU Baseball Team," Shirley said. "He was from Blaine, Minn.and attended high school at Centennial High. I will pass along more information as we have it regarding pending arrangements."
The Search for a missing Valley City State University Student presumed drowned after falling into the Sheyenne River Monday resumed Tuesday morning.
The accident occurred at about 1:15 Monday morning when a raft carrying three VCSU students capsized near the Little Dam in Valley City.
Valley City police responded to a third incident Monday afternoon, when a fish house trailer crashed into Victory Park 18 Apartments on Fifth Avenue Northeast in Valley City. A window and portion of the brick wall outside the basement unit were damaged, but no one was home at the time.
A source at the scene said the trailer became disconnected from the vehicle, which was traveling southbound on Fifth Avenue, and swerved into the northbound lane before hitting the building.
